When the 5th and the 6th Ministerial Conference of the WTO failed spectacularly in 2003 and 2005 respectively, because players like the EU and the US did not come to terms with a group of still developing, but nevertheless powerful countries like Brazil, China, and South Africa, the Doha-round virtually came to an end, thus fundamentally challenging the institutional framework of global trade that has developed since 1947 and 1995, respectively. Against this backdrop, this book discusses both fundamental problems of world trade law, like its position in the system of public international law or problems of legitimacy and democratic control, and some of the more practical items on the agenda: Does the "Doha-Development-Round" really foster development? Is it possible to reconcile intellectual property protection with the health protection for the poor? Renowned international lawyers and economists discuss these and other problems, providing some new answers a lot of food for thought.
